TERMS AND CONDITIONS

effective from 22 April 2026

These Terms and Conditions apply to all Battle Tested e-shops. They are governed by the law of the Slovak Republic, where the seller is established. Mandatory consumer protection provisions of each EU buyer's country of residence apply additionally, in accordance with Regulation (EC) No. 593/2008 (Rome I), Article 6.

I. General provisions

  1. These Terms and Conditions ("T&C") govern the relationship between the seller Marek Šľachta – Battle Tested ("seller") and the buyer when purchasing from any Battle Tested e-shop ("e-shop").
  2. The T&C apply to consumers – natural persons purchasing outside the scope of their business activity. Relations with business buyers are governed by the applicable commercial law of the seller's jurisdiction.
  3. By submitting an order the buyer confirms acceptance of these T&C, which form part of the purchase contract. Any individually agreed terms take precedence.
  4. Information on personal data processing is available in the Privacy Policy on the relevant e-shop website.

II. Payment and delivery

  1. Payment options include credit/debit card, bank transfer, and Google Pay. Cash on delivery is available only for specific countries and carriers – see the Shipping section of the relevant e-shop for current availability.
  2. We deliver to the countries listed in the Shipping section of each e-shop. Product availability varies by country due to legal restrictions on regulated goods (see section X).
  3. Delivery times depend on the selected carrier and destination. Current estimated delivery times are shown at checkout and detailed in the Shipping section of each e-shop.
  4. We reserve the right to restrict available payment or delivery options based on the nature of the goods or the delivery destination.

III. User account

  1. A user account is available for managing orders. Account credentials are personal – keep them secure and up to date.
  2. The seller is not liable for damages resulting from unauthorised access to a buyer's account by third parties.
  3. The seller may temporarily restrict an account for maintenance purposes or terminate it in case of prolonged inactivity or breach of these T&C.

IV. Goods and prices

  1. Prices include applicable VAT at the local rate of the e-shop or delivery address (see section V for details on EU shop VAT handling). Shipping and cash-on-delivery fees are shown separately during checkout. We may change the offer and prices at any time.
  2. In the event of an obvious pricing error, we are not bound by that price and no contract is formed. We will notify you immediately in such a case.
  3. Goods listed as opened, used or damaged may not be returned on those grounds. All other warranty rights remain unaffected.
  4. For discounted items we display the lowest price applied in the 30 days prior to the discount, in compliance with the EU Omnibus Directive (Directive 2019/2161).

V. VAT and regional pricing

Orders within the EU

  1. Each EU country has a different VAT rate. You will be charged VAT corresponding to your delivery address. We collect and remit this VAT to the appropriate tax authorities under the EU One Stop Shop (OSS) scheme, in accordance with EU regulations.
  2. Prices on the international e-shop (battle-tested.eu) are initially displayed with German VAT. You can manually select your location using the country selector in the menu, or the displayed VAT will automatically update once you enter a delivery address during checkout.
  3. If you provide a valid EU VAT number for a B2B purchase (reverse charge), prices will be displayed and invoiced without VAT.

Orders outside the EU

  1. VAT is not included in product prices at checkout for delivery addresses outside the EU. We do not charge VAT on such orders.
  2. The buyer may be responsible for local import taxes, duties and customs fees in the destination country. These charges are paid to the local authorities by the buyer upon or after delivery and are not covered by the purchase price.

VI. Order and contract formation

  1. Place the desired items in your cart and confirm by clicking "Order and pay". By submitting the order you accept these T&C.
  2. The contract is formed at the moment we send you an order confirmation by e-mail.
  3. We reserve the right to decline an order (e.g. out of stock, suspected misuse, product restricted in the destination country). You will be notified without delay in such cases.

VII. Delivery conditions

  1. We hand goods over to the carrier typically within 1–3 business days of order confirmation and receipt of payment. Estimated delivery times are shown at checkout and in the Shipping section of each e-shop.
  2. The buyer is obliged to accept delivery. If the buyer refuses without justification, we are entitled to recover the costs of re-delivery or return of the shipment.
  3. Title and risk of loss pass to the buyer upon taking delivery of the goods.
  4. Upon receipt, inspect the packaging for damage. Note any visible damage on the carrier's delivery slip and notify us immediately. Claims for transport damage reported later may not be accepted.

VIII. Right of withdrawal

Withdrawal right (EU buyers)

  1. If your delivery address is within the European Union, you have the right to withdraw from the contract without giving any reason within 14 days of receiving the goods, in accordance with EU Directive 2011/83/EU and its national implementations. Where multiple items are delivered separately, the period runs from receipt of the last item.
  2. You may exercise withdrawal via the online form on the e-shop (the system automatically generates and e-mails all required documents) or by the model withdrawal form in the annex to these T&C sent to team@battletested.sk or by post to the return address. Both methods are legally equivalent. The deadline is met if you send your notice on the last day of the period.
  3. After withdrawal, return the goods within 14 days at your own cost to the return address: Rozvojová 2, 04011 Košice, Slovak Republic. Goods must be undamaged, unworn and in original packaging. You are liable for any diminished value resulting from handling beyond what is necessary to assess the nature and function of the goods.
  4. We will refund all payments including standard delivery costs (excluding any surcharge for express delivery) within 14 days. We may withhold the refund until we receive the goods or proof of their dispatch.

Exceptions to the right of withdrawal

Under EU consumer protection law, the right of withdrawal does not apply to:

  • goods made to the buyer's specifications or clearly personalised;
  • goods that deteriorate or expire rapidly;
  • goods sealed for hygiene reasons that have been unsealed after delivery;
  • goods that have been inseparably mixed with other goods after delivery.

Orders outside the EU

For delivery addresses outside the European Union, the 14-day right of withdrawal under EU Directive 2011/83/EU does not apply. Returns are accepted only in cases of warranty claims or by individual agreement with the seller.

IX. Complaints and warranty

  1. We are liable for defects that appear within 24 months of delivery, in accordance with EU Directive (EU) 2019/771 and its national implementations. For buyers outside the EU, warranty terms apply as stated at the time of purchase.
  2. Submit a complaint via the online form on the e-shop (recommended – the system automatically generates a complaint record, sends confirmation and tracks deadlines), by e-mail to team@battletested.sk, or in writing to the return address. Submit without undue delay after discovering the defect.
  3. We will resolve the complaint within 30 days and issue written confirmation. The warranty period is extended by the duration of any repair or replacement.
  4. The warranty does not cover damage caused by the buyer, improper use or storage, unauthorised modification of the goods, or normal wear and tear.
  5. Complaints can be submitted to team@battletested.sk. If you are not satisfied, you may contact the competent consumer protection authority in your country (see section XII).

X. Regulated goods

  1. Certain products are subject to specific legal restrictions (e.g. magazines, ballistic protection, night vision, radios, pepper spray, IR lasers). Applicable conditions and country-specific restrictions are stated on individual product pages.
  2. The buyer declares that they are legally entitled to acquire and possess the goods in their country of use and that they are at least 18 years of age.
  3. We may decline an order if we have reasonable grounds to suspect misuse or if the product is restricted in the destination country. If a buyer provides a false declaration, they bear full legal and financial responsibility for all consequences and shall indemnify us against any resulting claims.

XI. Limitation of liability

  1. We are not liable for indirect damages, lost profits or consequential losses, unless caused by our intentional misconduct or gross negligence. Our total liability is limited to the purchase price paid.
  2. Goods are intended for lawful use. The buyer is responsible for using them in compliance with applicable laws and instructions.
  3. This limitation does not affect the buyer's mandatory statutory consumer rights under applicable national law.

XII. Dispute resolution

  1. If you are not satisfied with how a complaint was handled, contact us at team@battletested.sk. We will respond within 30 days.
  2. If we reject or fail to respond to your request, EU consumers may submit a proposal for alternative dispute resolution (ADR) to the competent authority in their country of residence:

XIII. Final provisions

  1. These T&C are governed by the law of the Slovak Republic, where the seller is established, in particular Act No. 40/1964 Coll. (Civil Code), Act No. 250/2007 Coll. (Consumer Protection Act) and Act No. 102/2014 Coll. (Distance Selling Act).
  2. Where the buyer is a consumer resident in another EU Member State, the mandatory consumer protection provisions of the buyer's country of residence also apply, in accordance with Regulation (EC) No. 593/2008 (Rome I), Article 6. The choice of Slovak law shall not deprive EU consumers of the protection afforded to them by mandatory provisions of their home country's law.
  3. Disputes shall be resolved by the competent courts of the Slovak Republic. The EU consumer's right to bring proceedings in the courts of their country of residence under the Brussels I bis Regulation (EU No. 1215/2012) is not affected.
  4. We may amend these T&C at any time. Amendments do not apply to contracts already concluded. The current version is always available on each e-shop.
  5. If any provision of these T&C is or becomes invalid, it shall be replaced by a provision closest in meaning. The remaining provisions remain in force.
  6. These T&C are effective from 22 April 2026.
