Personal Data Processing Terms
These terms of personal data processing (hereinafter referred to as the “Terms”) describe how Marek Šľachta - Battle Tested., located at Vrátna 44, 04001, Košice, ID 50537750, registered in the Trade Register of the District Court of Košice, Trade Register Number: 820-81873 (hereinafter referred to as the “Company” or “we”) processes your personal data for the purpose of providing our services, which consist of selling tactical and medical equipment through an online store (hereinafter referred to as the “Services”) on the website https://battletested.sk/ (hereinafter referred to as the “Website”), as well as through other means of remote communication.
The Company is responsible for processing personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC [hereinafter “GDPR”] and Act No. 18/2018 Coll. on the Protection of Personal Data and on the Amendment and Supplementation of Certain Acts, as amended [hereinafter “Act No. 18/2018 Coll.”].
The Company has adopted all appropriate technical and organizational measures to ensure the protection of personal data.
“Personal Data”: Data relating to an identified or identifiable natural person who can be identified directly or indirectly, in particular by reference to a general identifier, another identifier such as a name, surname, identification number, location data, or online identifier, or by reference to one or more characteristics or features that form their physical, physiological, genetic, mental, economic, cultural, or social identity.
“Processing of Personal Data”: Any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collecting, recording, organizing, structuring, storing, altering, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing, or destroying.

Information Necessary for Registration and Access to the Website
For the purpose of registering on our Website and subsequently logging into our Website and accessing our personalized services on the Website, we process the following personal data: (i) your first name, (ii) surname, and (iii) email.

For the purpose of providing our Services (i.e., delivering the goods you ordered or providing the services you purchased), we process the following personal data: (i) your first name, (ii) surname, (iii) address, (iv) email, (v) phone number, and (vi) payment card information (particularly card number, expiration date, and CVV code).
Processing of this data is necessary for the performance of a contract to which you and we are parties. The legal basis for processing this information is Article 6(1)(b) GDPR.
Information Collected for Marketing Purposes
For the purpose of sending our news and/or newsletters, discount information, updates, improvements, offers, and other marketing materials in the form of emails, SMS messages, postal mail, and/or notifications, we process your: (i) first name, (ii) surname, (iii) email, (iv) phone number, and (v) address.
We process this personal data based on your explicit consent. The legal basis for processing this information is Article 6(1)(a) GDPR.
If you decide that you no longer wish to receive such messages, you have the right to withdraw your consent by clicking on the hyperlink directly in the email communication. Withdrawing consent may result in you not receiving notifications about discounts, updates, improvements, and offers. It is not possible to withdraw consent to receive emails related to the provision of Services.
Information Collected During Your Use of Our Website
For the purpose of continuously improving our Services and enhancing your user experience on our Website, we process information related to: (i) your computer, (ii) visits to or use of our Website and/or Services (including your IP address, geographical location, browser type and version, operating system, referral sources, visit duration, page views, and navigation on our Website or similar information that the Company may obtain directly or indirectly from third-party providers), (iii) generated during your use of our Website and/or Services or generated in the course of using our Services (including scheduling, frequency, and pattern of use of the Website).

For the purpose of leaving a review or posting a comment on our Website, we will process personal data that you leave along with the review/comment on our Website, including your: (i) first name, (ii) surname, (iii) alias chosen for leaving the comment/review, and (iv) any other data you choose to include in the review/comment.

For the purpose of communicating with us for any reason (e.g., support for using the Website/Services, complaints, resolving any issues, etc.), we will process the following personal data: (i) your first name, (ii) surname, (iii) address, (iv) email, (v) phone number, (vi) communication content, (vii) metadata associated with the communication, and (viii) any other necessary data you choose to include in the communication.
Processing of this data is necessary for the performance of a contract to which you and we are parties. The legal basis for processing this information is Article 6(1)(b) GDPR.
Information Collected During Complaint Procedures
During a complaint procedure based on a claim you make regarding goods or services provided by us, we will process personal data primarily in the scope of (i) first name, (ii) surname, (iii) email, (iv) phone number, (v) address, and (vi) IBAN.
Processing of this personal data is necessary to fulfill our legal obligations, primarily under Act No. 250/2007 Coll. on Consumer Protection as amended and Act No. 40/1964 Coll. Civil Code. The legal basis for processing this information is Article 6(1)(c) GDPR.
ON WHAT BASIS CAN WE PROCESS YOUR PERSONAL DATA?
In addition to what is stated above, we have the right to process your Personal Data for the purpose of fulfilling our legal obligations under Article 6(1)(c) GDPR or to protect our legitimate interests under Article 6(1)(f) GDPR, such as fraud prevention, network and information security, and direct marketing.
We will process your Personal Data in compliance with applicable laws and will protect your Personal Data against misuse and/or unlawful disclosure.
HOW DO WE SHARE YOUR PERSONAL DATA?
To enable access to our Website and/or Services (and as reasonably necessary), we have the right to provide your Personal Data (and you consent to such provision) in accordance with the principle of data minimization to a limited range of persons, including our employees, subcontractors, officers, advisers, business representatives, suppliers, or associated persons of the Company and service providers to the extent necessary to achieve the purpose stated in these Terms, specifically to the following persons:

DO WE TRANSFER YOUR PERSONAL DATA TO THIRD COUNTRIES?
The personal data we collect may be stored or otherwise processed and transferred within the countries where we conduct our business activities to achieve the processing purposes outlined in these Terms. HOW LONG WILL WE PROCESS YOUR PERSONAL DATA?
Unless otherwise specified by applicable legal regulations, we have the right to process your Personal Data in a form that allows your identification for the time necessary to achieve the purpose for which the Personal Data was provided. This may include the period during which you visit our Website or use our Services and/or the entire period during which the purpose of processing the Personal Data lasts. Unless stated otherwise, the following periods apply:

We will process the data necessary for registration and access to the Website from the day of your registration on the Website until 30 days from the day you cancel your registration. We will process the data necessary for providing Services from the day you ordered the Service until its demonstrable provision (i.e., until the day the goods are delivered and the price is paid).

The Company will provide you with your processed personal data without undue delay in the manner you request. For repeated provision of personal data that you request, we may charge a reasonable fee corresponding to administrative costs.
Correction of Personal Data
If you find that we process incorrect Personal Data about you, please inform us, and we will correct such incorrect data without undue delay. You also have the right to request the completion of incomplete personal data.
Deletion of Personal Data (Right to be Forgotten)
We will delete your Personal Data if: (i) the Personal Data is no longer necessary for the purpose for which it was collected, (ii) you withdraw your consent to the processing of personal data under the conditions specified in these Terms, (iii) you object to the processing of Personal Data, (iv) we have obtained your Personal Data unlawfully, (v) we have a legal obligation to delete your Personal Data, or (vi) the Personal Data was obtained in connection with the offer of information society services.
In the case of deleting personal data at your request, we will also take appropriate security measures to inform other controllers processing your personal data about this request so that these controllers delete references to this personal data and its copies or transcripts.
Restriction of Personal Data Processing
You have the right to restrict the processing of your Personal Data if: (i) you contest the accuracy of the Personal Data, and this for the period allowing verification of the accuracy of the Personal Data, (ii) the processing is unlawful and you oppose the deletion of the Personal Data and request the restriction of its use instead, (iii) we no longer need the Personal Data for the purposes of processing, but you need it for the establishment, exercise, or defense of legal claims, or (iv) you have objected to processing and verification is pending whether our legitimate grounds override yours.
If the processing of personal data is restricted, apart from storage, personal data is processed only with your explicit consent or for the establishment, exercise, or defense of legal claims, the protection of persons, or for reasons of public interest.
Portability of Personal Data
You have the right to receive your Personal Data, which we process, in a structured, commonly used, and machine-readable format for the purpose of transferring this Personal Data to another controller.
Object to the Processing of Personal Data
You have the right to object to the processing of Personal Data for direct marketing purposes, including profiling to the extent that it is related to direct marketing.
Initiate Proceedings Before a Supervisory Authority
If you suspect that your rights related to the protection of your Personal Data have been violated, you have the right to initiate proceedings before the supervisory authority – the Office for Personal Data Protection according to § 100 et seq. of Act No. 18/2018 Coll.
DO WE USE AUTOMATED DECISION-MAKING AND PROFILING? HOW DOES IT WORK?
We do not use automated individual decision-making (i.e., collecting your Personal Data, which is then evaluated by technical means without any human intervention, and based on such evaluation, we further provide you with our Services) or profiling (i.e., collecting and evaluating your Personal Data as well as data about your behavior on our Website to categorize you into a certain group of people and subsequently analyze and predict your interests, future behavior, etc.) for the provision of our Services.
DO WE PROCESS PERSONAL DATA OF CHILDREN?
We consider the protection of your children’s privacy to be particularly important. For this purpose, we do not knowingly collect any personal data from individuals under the age of 16. If you are under 16, please do not send us any Personal Data, including your name, permanent address, phone number, or email address. No person under the age of 16 is authorized to provide their Personal Data on the Website. If we discover that any Personal Data we process relates to a person under the age of 16 without the consent of the legal representative of such a person, we will delete such Personal Data without delay. HOW DO WE PROCESS FINANCIAL TRANSACTIONS?
All financial transactions and operations performed electronically on our Website or in connection with our Services will be processed through online payment service providers ComGate Payments, a.s., Gočárova třída 1754 / 48b, Hradec Králové. We will provide your Personal Data to online payment service providers only to the extent necessary to process payments you make through our Website, refund such payments, and resolve complaints and queries related to such payments and refunds.
